Can my landlord raise my rent because I complained about plumbing? +
No. FL Statute 83.67 prohibits landlord retaliation. If your rent is raised or you receive an eviction notice within 60 days of a plumbing complaint, FL law presumes it is retaliation. You may be entitled to 3 months' rent in damages plus attorney's fees.
Can I just stop paying rent if my plumbing isn't fixed? +
Not without proper notice first. Under FS 83.56, you must send a 7-day written notice to your landlord before withholding rent. Withholding rent without proper notice can result in eviction, even if the landlord is in the wrong. Always consult a FL attorney or legal aid first.
My landlord says the clog is my fault โ€” what do I do? +
Document everything. If the clog is in the main sewer line, it is almost certainly the landlord's responsibility regardless of what went down the drain. Request a camera inspection report โ€” this shows where the blockage is and whether roots, pipe collapse, or debris is the cause. We provide written camera inspection reports.
What if the landlord turns off my water? +
This is illegal in Florida. FS 83.67 prohibits landlords from interrupting utilities (water, electricity, gas) as a method of eviction or coercion, even if you owe rent. This is a criminal act under FL law. Call the police and document it โ€” you may be entitled to immediate restoration plus damages.
Can I hire a plumber and deduct from rent? +
Yes, under FS 83.56, after sending a 7-day written notice and the landlord fails to act, you may hire a licensed plumber and deduct the cost from your next rent payment โ€” up to one month's rent maximum. Keep all invoices and notify the landlord in writing that you are exercising this right.
